New Regulations and form for Renewing Deferred Action Applicants Have Been Released

Secretary of Homeland Security Jeh Johnson announced today the process for individuals to renew enrollment in the Deferred Action for Childhood Arrivals (DACA) program. USCIS is now allowing individuals who previously applied for DACA to renew for a new  term of two years. Effective immediately, USCIS will begin accepting renewal requests.

The first DACA approvals will begin to expire in September 2014, so it is important to apply before your work authorization expires. Current holders of DACA must apply for renewal before the expiration of their DACA. We recommend to apply approximately 120 days (four months) before expiration.

You may apply for DACA renewal if you continue to meet the initial requirements and also these additional guidelines:

  • Did not depart the United States on or after Aug. 15, 2012, without advance parole;
  • Have continuously resided in the United States since they submitted their most recent DACA request that was approved; and
  • Have not been convicted of a felony, a significant misdemeanor or three or more misdemeanors, and do not otherwise pose a threat to national security or public safety.
  • The renewal process begins by filing a NEW Version of the form “Consideration of Deferred Action for Childhood Arrivals,”

There is a filing fee and a biometrics fee for applying in the amount of $465. Processing DACA renewals will remain the same as the initial application with the background check

By January 2015, undocumented immigrants will be able to get driver’s licenses in California

Gov. Jerry Brown signed into law a bill granting driver’s licenses to immigrants lacking legal immigration status.  California now joins the District of Columbia and nine other states that have passed such a law.  In California, the bill authored by Democratic Assemblyman Luis Alejo would grant licenses to anyone who passes written and road tests, regardless of immigration status. State officials estimate 1.4 million drivers will apply for licenses under the law, which was supported by the state’s Police Chiefs Association and insurance authorities.  The law will take effect on January 1, 2015.  To watch more on this click below.

Senado aprobó moción para proceder al debate de la reforma migratoria

PROGRESO EN EL MOVEMENTO PARA LA REFORMA INMIGRATORIA…

Anteproyecto de ley S. 744 que incluye una vía de legalización para indocumentados se abre paso en el pleno

Por amplia mayoría (82 a favor y 15 en contra) los senadores aprobaron el martes una moción para proceder al debate de la reforma migratoria con ciudadanía, plan que fue redactado por el Grupo de los Ocho y aprobada a finales de mayo por el Comité Judicial.

La votación fue la primera de dos procesos que concluidos el martes. En la segunda votación los senadores votaron 84 a favor y 15 en contra para abrir oficialmente el debate. El paso sólo requería requería mayoría simple (51 votos de los 100 asientos en el hemiciclo).

Previo a las votaciones defensores y detractores de la reforma migratoria expusieron sus alegatos. En la Casa Blanca, el presidente Barack Obama urgió al Senado a debatir cuanto antes y aprobar el proyecto que, dijo, permitirá reparar un sistema de inmigración que se encuentra roto.

Obama dijo que la reforma migratoria, de ser aprobada por ambas cámaras del Congreso, le dará rostro a los indocumentados, y agregó que “no hay razones para que el Congreso no pueda hacer esto antes del fin del verano”.
