Who qualifies?
If you, a family member, friend, or neighbor is the:

  • Spouse of a U.S. citizen or a child of a U.S. Citizen between 17-21 years of age.
  • Is present in the United States at the time of filing the application.
  • Who is inadmissible only on account of unlawful presence, and
  • Who demonstrate the denial of the waiver would result in extreme hardship to his or her U.S. citizen spouse or parent

They currently qualify to apply for Permanent Residency Status without having to wait outside the U.S for an extended period. Waivers will now be processed within the U.S!!

Do you need an attorney to apply?Yes, it is highly advised. To apply for permanent residency though these new process will require the applicant to present forms in three different stages:

  • File for a family petition (this may take more or less 6 months to approve)
  • Apply for provisional waiver
  • Consular Process, which includes an interview and a medical exam
