They currently qualify to apply for Permanent Residency Status without having to wait outside the U.S for an extended period. Waivers will now be processed within the U.S!!

Do you need an attorney to apply?Yes, it is highly advised. To apply for permanent residency though these new process will require the applicant to present forms in three different stages:

  • File for a family petition (this may take more or less 6 months to approve)
  • Apply for provisional waiver
  • Consular Process, which includes an interview and a medical exam

While each case is different, the Provisional Waiver will be the hardest part of the process for most applicants. It will require showing that the U.S. citizen family member will suffer “Extreme Hardship.” This is done by reviewing and presenting medical and mental health history, immigration attorney should guide the applicant in this process.
