Deferred Action Approved For 4,600 & Importance of Applying in view of Rommey’s Statements last week

As of Wednesday, nearly 180,000 had applied for deferred action, DHS reported. About 158,000 are being checked for criminal records, while around 6,400 are on the final step of review.
The speed with which DHS processes deferred action applications has renewed importance in light of remarks by Republican presidential nominee Mitt Romney, who said last week that he would end the deferred action policy but honor the applications already approved under the Obama administration.
Romney’s campaign confirmed that those still in line for deferred action wouldn’t be given consideration if he became president, meaning many undocumented immigrants with pending applications would be left in the cold.
That could affect a lot of people. DHS noted that the pace of these early acceptances isn’t necessarily reflective of how quickly the rest of the decisions will be made. While the 4,600 applications were approved within two months of submission, the department predicts the average time to process requests will be four to six months, spokesman Peter Boogaard said in a statement.

Immigration Finally in the Mainstream

The Dream Act movement, and the young undocumented immigrants pushing Congress to pass the immigration reform legislation, have entered the political mainstream.
In 2010, Gaby Pacheco was a frustrated college student planning a 1,055-mile protest walk from Florida to Washington, D.C.
The leaders and policy directors of most of the country’s largest Latino Civil Rights organizations — the National Council of La Raza (NCLR), The League of United Latin American Citizens (LULAC) and others — told Pacheco that the plan she had made with three other college students to march from South Florida, though the old South and to the capital, was an unreasonably dangerous “suicide mission” — unlikely to move hearts and minds, or change public policy.
This week, Pacheco has been a featured panel speaker at no less than four different events staged at the Democratic National Convention, and she is one of several young undocumented students who have been lauded by Latino political operatives, consultants, long-time activists, community organizers, delegates and other party faithful gathered in Charlotte. One young undocumented woman, Benita Veliz, even gave a speech on the DNC’s main stage Wednesday night. All thanks to a few who decided to take a stand and take action.

Letting illegal immigrants get driver’s licenses makes sense

“For 60 years, California had the safest highways in the country,” observes Assemblyman Gil Cedillo (D-Los Angeles). “Then we started playing immigration politics with highway safety, and our highways got a lot less safe.”
Cedillo has been trying to restore driving license rights for illegal immigrants since 1998, when he joined the state legislature. At this moment he has his fingers crossed, for at least the ninth time in his career, that California might be chipping away at the roadblocks. His latest bill to make at least some undocumented immigrants eligible for licenses won passage in the legislature last month and awaits Gov. Jerry Brown’s signature.

Why Dreamers Need Lawyers

From www.dreamactivist.org – “I’m a Dreamer. I’m also a full-time third-year law student. I work at an immigration law firm in downtown Washington D.C. and I love my job. Like many immigrants in the United States, my family and I were screwed over by immigration lawyers and school administrators, which left me without legal status in the United States. As such, I have an inherent dislike of immigration lawyers as there are many bad ones in the profession. At the same time, I’ve had the pleasure of knowing some really great immigration lawyers who’ve helped me out on innumerable occasions. , I have to come out strong against several politicians and non-profits who are spreading the dangerous and irresponsible messaging that Dreamers do not need lawyers for the new deferred action process starting on August 15. I’d strongly advise my fellow Dreamers to get a competent immigration attorney to draw them an immigration history chart to ascertain precisely what benefits they could be eligible for now and in the near future… may be eligible to adjust your status to that of a lawful permanent resident. It also does not hurt to see an immigration attorney especially if you have crimes or convictions on your record. Sometimes, a lawyer can get you post-conviction relief, and USCIS will most likely honor that. Second, in most cases, local non-profits do not have the legal expertise to answer tough legal immigration questions regarding legal terms like continuous presence, unlawful presence, advance parole in individual cases. For the most part, they have never actually practiced immigration law.”

The correct more appropriate term is “Undocumented Immigrants.” “As a general rule, it is not a crime for a removable alien to remain present in the United States.” The Supreme Court ruled that it was not a crime to seek or engage in unauthorized employment. As Justice Kennedy explained, removal of an unauthorized migrant is a civil matter where even if the person is out of status, federal officials have wide discretion to determine whether deportation makes sense.
